You consent and submit to the exclusive jurisdiction of the state and federal courts in Hernando County, Florida, United States of America, in all questions and controversies arising from your use of this site and this Agreement. To the extent allowed by applicable law, any claim or cause of action arising from or relating to your access or use of this site must be brought within two (2) years from the date such claim or action arose or accrued.

15. ATTORNEY’S FEES. If NAIC, Inc. / ThaiMassage.Com or its affiliates take any action to enforce this User Agreement and these terms and conditions, such parties will be entitled to recover from you. You agree to pay all reasonable and necessary attorney’s fees and any cost of litigation, in addition to any other relief, at law or in equity, to which such parties may be entitled.

16. INJUNCTIVE RELIEF. You acknowledge that a violation or attempted violation of any of this User Agreement and these terms and conditions will cause such damage to NAIC, Inc. / www.ThaiMassage.Com as will be irreparable, the exact amount of which would be difficult to ascertain and for which there will be no adequate remedy at law. Accordingly, you agree that NAIC, Inc. / www.ThaiMassage.Com shall be entitled as a matter of right to an injunction issued by any court of competent jurisdiction, restraining such violation or attempted violation of these terms and conditions by you or your affiliates, partners, or agents, as well as recover from you all costs and expenses sustained or incurred by NAIC, Inc. / www.ThaiMassage.Com in obtaining such an injunction, including, without limitation, reasonable attorney’s fees. You agree that no bond or other security shall be required in connection with such request.

17. TERMINATION. NAIC, Inc. / ThaiMassage.Com may terminate this User Agreement and these terms and conditions or the provision of any services at any time for any reason, including any improper use of this site or your failure to comply with these terms and conditions. Upon termination of this User Agreement and these terms and conditions, all rights granted to you will terminate and revert to NAIC, Inc. / www.ThaiMassage.Com and its third-party providers or distributors, as applicable. Such termination shall not affect any right to relief to which NAIC, Inc. / www.ThaiMassage.Com and its third-party providers and distributors may be entitled, at law or in equity.

18. ASSIGNMENT. You may not assign, convey, subcontract, or delegate your rights, duties, or obligations.

19. MODIFICATION. NAIC, Inc. / ThaiMassage.Com may modify these terms and conditions at any time, and your continued use of this site will be conditioned upon the terms and conditions in force at the time of your service.

20. ADDITIONAL TERMS. Additional terms and conditions may apply to reservations, purchases of goods and services, and other uses of portions of this site, and you agree to abide by such additional terms and conditions. You acknowledge that some third-party providers offering certain services or activities may require you to sign their liability waiver before participating in the service or activity they offer. You understand that violating any such supplier’s rules and restrictions may result in canceling your reservation(s), denying access to the applicable travel product or services, and forfeiting any monies paid for such reservation(s). NAIC, Inc. / www.ThaiMassage.Com may debit your account or charge you for any costs we incur due to such a violation.

21. SEVERABILITY. These terms and conditions shall be deemed severable. If any provision is unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law. Such determination shall not affect the validity and enforceability of any other remaining provisions.

22. HEADINGS. The headings in this User Agreement are included for convenience only and will not limit or otherwise affect the terms and conditions herein.

21. ENTIRE AGREEMENT. This User Agreement, together with any terms and conditions incorporated herein or referred to herein, constitute the entire agreement between us relating to the subject matter hereof and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified except in writing or by making such amendments or modifications available on this site.

23. Thailand Study Tours Cancellation & Refund Policy

Participant agrees to Cancellation and refund policy as a pre-condition to enrollment. Price is set with a deposit; otherwise, it is subject to change at any time. Active Travel Medical Insurance is required. Please Note: Although this trip is designed for students, it is well-supervised and escorted by our staff. No one teaches classes–they are all taught by Certified and recognized Master Instructors. All of our guides are professionally licensed and insured by the Thai Government. Most, if not all, are Thai Citizens with college degrees in related Humanities. Food/ meals are not included. This is NOT a classic budget trip/carry your food sleep where you can/ get by as best you can (maybe) excursion- which some other less experienced agents may be offering. Do not settle for less than the best! If they offer accessible accommodations or travel, you can bet there is some corner-cutting somewhere!

If you’re considering another excursion, ask them if they provide bonded, licensed drivers or their vehicles. Do they expect you to share bathing and shower accommodations? Do they guarantee exactly who all staff is and their level of professional certification? Are they insured? Will an owner of the company accompany the group, and will there always be someone available to translate as necessary? We do cover all of these issues and more. Please note that any similarity to non-NAIC, Inc. affiliated or non-approved Thai Yoga and or Thai Massage programs is coincidental and unintentional. We reserve the right to work with and promote local Thailand resources for quality education in partnership with our US-based certification programs. Program providers in Thailand maintain their own separate and specific licensing as required by various Thai laws and are responsible for keeping their licensing up to date. Participants will be furnished with details and specifics of the provider’s licensing upon request. “BareBones” programs are budget programs and do not meet the same criteria for supervision and general standards as our escorted “Thailand Externship Programs.” Reservations are based on a twin-share basis. All prices, terms, conditions, and descriptions are subject to change any time. As stated in the Standard Agreement and Waiver, NAIC, Inc. may offer this and any of its programs with various providers and NAIC, Inc. affiliates, tour operators, and airlines. Courses and program content of equal or more excellent value may be substituted at any time without notice. Terms for this program are subject to change at any time. All programs are only guaranteed with a paid-in-full registration, subject to availability.
